An uncontested divorce can be filed when every issue has been resolved and settled on by the parties before filing the case. Issues that need to be agreed upon include child custody, visitation, child support, alimony (if any), division of assets, division of debts and attorney’s fees. If any issue has not yet been settled and agreed upon by both parties, it remains a contested divorce. Thus, even a small unresolved issue can lead to a contested divorce, because in the state of Georgia, a divorce cannot be granted until either all the relevant divorce issues are settled or the case is tried.
In the case that both parties agree on all of the details of the divorce, an uncontested divorce can be approved in as little as 31 days after the defendant receives the divorce complaint. The process may take longer if there are minor children involved.
An uncontested divorce is the right solution for you and your spouse if you can reach an agreement on the following issues:
- How the marital property will be divided. This includes homes, rental property, car, retirement accounts, mortgages, automobile loans, stock options, etc.
- How the marital debt will be divided. This includes mortgage debt, 401k loans, personal loans, automobile loans, tax debt and credit cards.
- Who will have primary custody of the children; including very specific details regarding visitation and custody.
- How much child support will be paid, including terms for health insurance, child care, activities, etc.
- Whether alimony is to be paid – and if so the amount and duration.
- Who will pay the attorney’s fees and the cost of the divorce.
If any of these issues are not resolved and agreed upon, the divorce will be obtained when the case reaches the court, which can take many months. An uncontested divorce can be settled out of court, and, usually, even if a court date is necessary, it is to verify the agreement with both parties prior to approval.
